1. Acceptance of Terms
By downloading, installing, or using the Oratey application ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms apply to all users of Oratey.
2. Description of Service
Oratey is an AI-powered speaking and expression training application that provides scenario-based practice, expression framework training, and AI-generated coaching and evaluation. The App is available on iOS and Android platforms.
3. Account Registration
To use certain features of Oratey, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information when creating your account and keep it updated.
4. Your Content and Data
You retain full ownership of all content you create or record in Oratey, including voice recordings, practice sessions, and any other content you provide ("Your Content"). We do not claim any license or ownership rights to Your Content. Your Content is processed solely to provide the Oratey service to you — for speech recognition, AI feedback, and evaluation scoring. We will never use Your Content to train AI models, share it with third parties, use it for advertising, or use it for any purpose other than delivering the service directly to you. This is consistent with our Privacy Policy, which you should also read.
5. Subscription and Payment
Oratey offers both a free tier and a paid Pro subscription. Subscription fees are billed in advance on a monthly or annual basis depending on the plan selected. All payments are processed through the App Store (Apple) or Google Play (Google) according to their respective payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Refunds are subject to the policies of Apple App Store or Google Play.
6. Acceptable Use
You agree not to:
- • Use the App for any unlawful purpose
- • Attempt to reverse-engineer, decompile, or extract source code from the App
- • Use the App to generate content that is harmful, harassing, or illegal
- • Share your account credentials with others
- • Use automated tools to access the App in unauthorized ways
7. AI-Generated Content
The AI coaching, feedback, and evaluations provided by Oratey are generated by artificial intelligence systems and are provided for educational and practice purposes. They are not professional coaching, psychological advice, or career counseling. AI output may contain errors. You should use your own judgment when applying feedback.
8. Intellectual Property
All intellectual property in the Oratey App — including frameworks, training content, design, and software — is owned by or licensed to Oratey. You may not reproduce, distribute, or create derivative works from the App's content without our express written permission.
9. Termination
You may terminate your account at any time through the App's account settings or by contacting support@oratey.com. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases, and your data will be deleted in accordance with our Privacy Policy (within 30 days).
10. Disclaimer of Warranties
Oratey is provided 'as is' without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that the AI coaching will achieve specific results. Use of the App is at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, Oratey shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance of the updated Terms.
